The question is rather what kinds of regulation ought we pursue - the AI bill of rights is already a good start. Users should be informed when interacting with AI (or subjugated to algorithmic decision making) and should have avenues to address/appeal such decisions.
You're talking about regulation as a restriction on AI. That, I don't agree with. We don't limit humans ability to think, we regulate boundaries between humans impacts on each other.
AI should be handled similarly. Regulation should be set regarding privacy rights and authority. Similar to if a human breaks those boundaries are when enforcement measures should play a role. Whether that's punishing the ai or the ais handler or developer is also what ought to be addressed.
